Terms and Conditions

By using the services provided by MyTuningFiles, you (the "Customer") agree to the following terms and conditions. Please read them carefully before downloading or flashing any tuning files.

1. Responsibility of the Customer:

   • It is the Customer's responsibility to use only genuine and original tools to flash tuning files provided by MyTuningFiles. Clone tools should be used on your own risk.

   • The Customer must ensure they have a complete backup of their engine control unit (ECU) before flashing any files. MyTuningFiles is not responsible for any loss, damage, or malfunction to the ECU or vehicle resulting from the use of our files.

2. File Usage and Compatibility:

   • MyTuningFiles makes no warranty regarding the compatibility of tuning files with your specific vehicle, ECU, or hardware if you flash wrong file or using wrong (different tool).

   • The Customer understands and accepts that any use of the tuning files is at their own risk. If the Customer is unsure about the compatibility of the file, they should contact MyTuningFiles for further clarification.

3. Limitation of Liability:

   • MyTuningFiles does not accept liability for any issues arising from the use of our tuning files, including but not limited to engine malfunctions, ECU errors, or any damage caused to the vehicle during or after the flashing process.

   • The Customer accepts full responsibility for any repairs or modifications required as a result of using the tuning files.

4. Refund Policy:

   • As a general rule, MyTuningFiles does not issue refunds for services rendered. This policy is due to the nature of our payment processing, which imposes fees on us for refunds.

   • However, if there is a serious, unresolved issue with the tuning file, and the complaint is deemed reasonable, MyTuningFiles will offer the Customer credit towards a future file or service. This is subject to review and determination on a case-by-case basis.

5. Customer Support:

   • MyTuningFiles offers support for issues related to the files we provide. However, we are not responsible for troubleshooting any issues that arise due to third-party software or hardware used by the Customer.

   • If a file does not perform as expected, the Customer must provide full details of the issue, and we will make reasonable efforts to address the problem. If we are unable to resolve the issue, the Customer may be eligible for a credit as outlined in Section 4.

6. Intellectual Property:

   • All tuning files provided by MyTuningFiles are protected by intellectual property laws. The Customer is granted a non-transferable, non-exclusive license to use the files on their vehicle.

   • The Customer is prohibited from sharing, publishing, or otherwise making the files available to public.

7. Data Privacy:

   • MyTuningFiles takes the privacy of our Customers seriously. Personal information provided by the Customer will only be used in accordance with our privacy policy, which can be found on our website.

8. Governing Law:

   • These terms and conditions are governed by the laws of Lithuania. Any disputes arising from the use of our services will be resolved in the appropriate legal venue within Lithuania.

By proceeding with the services of MyTuningFiles, the Customer acknowledges and agrees to these terms and conditions. If the Customer does not agree with any part of these terms, they should refrain from downloading or flashing any tuning files.
